| Do I need a Home Information Pack if I am selling my property privately? In England and Wales it is now compulsory to have a Home Information Pack (HIP) available from the first day a property is put on the market. This is true if you are selling through an estate agent, solicitor or privately. If you are selling your property without any marketing (selling to a family member for example) you do not need a Home Information Pack (HIP). You also do not need a HIP if the property is non-residential, limited by law for use as holiday accommodation or occupation for less than 11 months per year, mixed sales (for example a shop with a flat), when selling two or more properties together, when the property is not being sold with completely vacant possession (for example with a sitting tenant), unsafe properties and properties due to be demolished, and properties sold through the ‘Right to Buy’, ‘Right to Acquire’ and ‘Social HomeBuy’ home ownership schemes. For more information on Home Information Packs visit the DirectGov website. In Scotland all properties on the market must have a Home Report unless they have been on sale continously since before the 1st of December 2008. This is the case whether you are selling your property through an estate agent or selling it privately. For more information on Home Reports in Scotland please visit the Scottish Government website. In Northern Ireland there is currently no requirement to provide a Home information Pack or similar. However, in keeping with EU law, an Energy Performance Certificate (EPC) to any prospective buyer or tenant of a property when it is either sold or rented out. |
